This map shows the land donated by Lake Orange, Inc. (LOI) to Orange County in 1967. The land was used to create Lake Orange, with Orange County taking possession of land beneath the surface of the lake and the area of land surrounding the dam at the south area of the lake (the "Dam Clearing and Spillway Control Area"). Ownership of a strip of land around the lake falling between the 615' and 620' elevations was retained by Lake Orange, Inc. The dam and associated control area are shown at the left edge of the document, with the north arrow shown near the top left of the page. The shaded area around the lake indicates Lake Orange, Inc. property between the 615' and 620' contours. The "E-E" and "F-F" lines at the north end of the lake are also defined, establishing the northermost limits of the Lake Orange, Inc. property. The original property boundaries of Tolar, Walker, Nichols, Ray, and Patterson are shown, with those original owners retaining ownership of propety above the 620' elevations. No other parcels or ownership rights are defined around or near Lake Orange.
This deed was executed and recorded between Lake Orange, Inc. and Orange County on August 4, 1967. The deed formalizes donation of land from Lake Orange, Inc. to Orange County for the purpose of constructing Lake Orange as a public water supply. The deed establishes Orange County ownership of land below the 615' elevation, of a planned dam and spillway and associated control area, and of the access rights to Lake Orange through property owned by Lake Orange, Inc. Lake Orange, Inc. retained ownership of the land falling between the 615' and 620' elevations and ownership of all recreation rights on Lake Orange. Notably, the deed also establishes Orange County ownership of a perpetual flood easement over all property between the 615' to 620' elevations, including a right of first refusal that would enable the County to purchase any of this property, were it ever offered for sale by Lake Orange, Inc.
Lake Orange is a Class WS-II reservoir, which means it is a primary drinking water source. Per State of North Carolina law, recreation is permitted on WS-I and WS-II reservoirs only when granted by the North Carolina Commission for Public Health, the primary rule-making body for the North Carolina public health system.
Fundamentally, the 1967 deed with Orange County grants Lake Orange, Inc. ownership of the 615'-620' elevations and ownership of the recreation rights on Lake Orange. The lake itself, the impounded water, and the dam and spillway are owned by Orange County after Orange County constructed the lake and the control structures on land donated to Orange County by Lake Orange, Inc.
The 1970 Resolution by the NC State Board of Health (so named at the time) grants Lake Orange, Inc. the authority to access the recreation rights that they own. Regulation of the watershed, and especially of reservoirs, is a responsibility that is shared between the State of NC and local municipalities.
