1988 Contract with Lattimore
In 1988, LOI entered into an agreement with the Lattimores, owners of property located near the southwest corner of the lake to enable the Eno River Estates Homeowners Association, Inc. to build a private recreation area on the lake, near the western end of the dam, accessible to their homeowners. The recreation area would be built on LOI-adjacent land owned at that time by the Lattimores, with required terms including an annual fee to Lake Orange, Inc. The recreation area was never built, the property was eventually sold, the annual fees were not paid, and the agreement is thus void.
A 1990 agreement settled a lawsuit between Lake Orange, Inc. and the owners of some property near the lake. The defendants agreed to release their claim of ownership to the strip of land near the water—between the 615' and 620' contours. In return, Lake Orange, Inc. reaffirmed conveyance of the easement originally granted to Walker, and also granted the owners the right to continue normal landscaping and maintenance of the strip of property, subject to any restrictions imposed by Orange County.
